GENERAL TERMS

for online reservations of hotel services in Hotel Laguna Park & Aqua Club, Sunny Beach resort, through the hotel's website:

1. RESERVATIONS:

1.1. Room reservations can be made as follows: by clicking the "Make a reservation" button on the Hotel Laguna Park & Aqua Club, Sunny Beach website, you will be directed to the online booking form, where you must fill in the following information: period, number of nights, number of rooms, number of adults, children up to 11 years, and babies up to 1 year. Following the completion of the data, the possible booking options - room types, types of offers, and their corresponding prices - will be visualized. To make your reservation, enter your personal information after selecting the desired offer: name, surname, e-mail address, credit card number, credit card validity, names written on the card, and Card Security Code (CVV2 / CVC). Please review the details of your reservation, which are displayed in the field on the right, read the conditions, and if you want to make a reservation based on the parameters described in the offer and conditions, check "I accept the conditions" and click "Confirm & Make a reservation". Your reservation has been made, and you will receive confirmation at the e-mail address you provided.

2. PRICES AND PAYMENT METHOD:

2.1. Hotel Laguna Park & Aqua Club, Sunny Beach guarantees the usage of services requested and paid for by the customer for online booking based on the following information: client's name, period, number of nights, number of people and children under the age of 11, normal and extra beds, price per night. Guests aged 12 and up will be charged as adults. The "Remarks" area on the reservation form is not contractually binding for Hotel Laguna Park & Aqua Club, Sunny Beach, and all special requests entered in this field will be met to the best of our ability.

2.2. The prices on the Hotel Laguna Park & Aqua Club, Sunny Beach website are displayed in the client's preferred currency and are paid in EUR at the current DSK Bank AD exchange rate, which includes 9% VAT, tourist tax, and hotel insurance. The total amount owed on the reservation by the customer is automatically calculated based on the number of days, the number of adults and children (according to their ages), and the current price offer for the period. The reservation booked and paid for through the online reservation system is guaranteed with the required advance payment as per the offer. Please note that reservations without prepayment are only valid and guaranteed if this is explicitly stated in the offer's terms. They are not guaranteed, and under the terms of the offer, guests will not be accommodated on reservations that require advance payment. Hotel Laguna Park & Aqua Club, Sunny Beach reserves the right to change prices and special offers on its website at any time. The amount due does not change in the case of previously made, confirmed, and paid reservations, regardless of new price offers submitted.

2.3. Payment can be made electronically with a debit or credit card via a virtual POS terminal, by bank transfer, or in cash. We accept Visa, MasterCard, and Maestro credit cards for electronic payments. When you use this payment method, you create your own reservation and manage the payment process in the online reservation portal on the Hotel Laguna Park & Aqua Club, Sunny Beach website. DSK Bank AD's payment page appears after you create and confirm the reservation and proceed to its payment. The payment screen ensures that the customer's information is completely secure. On this screen, the customer enters the information on his/her card, including the names written on the card, the type of card, the number, the validity period, and the CVV2 / CVC2 code. For cards that require additional 3-D authentication and for which you are registered in the Verified by VISA or MasterCard SecureCode authentication schemes, your Issuing Bank's authentication page opens, where you enter your authentication password. In order to be able to use your debit card for online payments, you need to activate this service according to the terms of your bank. Important: The Hotelier does not have access to the data from the cardholder's card at any time during the creation of the reservation, payment, or after payment. When a transaction is successful, a transaction note appears on the screen, which you can print and save. When you book online, the amounts specified will be automatically deducted from your card at the end of the payment process. You will receive a confirmation, number, and parameters of your guaranteed reservation after successfully paying the value of the created reservation.

3. CANCELLATIONS AND CHANGES IN RESERVATIONS

3.1 In the event of a reservation change, cancellation, no-show, or early check-out after the client has already paid for the reservation, Hotel Laguna Park & Aqua Club, Sunny Beach, retains the penalty in accordance with the terms of the booked price offer, as described in our Cancellation and Change Policy, namely: 

Price offers with the option of free reservation changes and cancellations up to one day before arrival.

Price offers with the option of free reservation changes and cancellations up to 14 days before arrival.

The client is entitled to a full refund of all amounts paid prior to the expiration of the above-mentioned deadlines, without penalty, but after deducting bank charges.

3.2. In cases of force majeure, which necessitates cancellation or change of the reservation, the client must provide the relevant documents and evidence of his/her inability to travel during the period for which he/she made the reservation. After proving the force majeure, the amounts paid will be refunded in full to the client, with no penalty imposed by the Laguna Park & Aqua Club Hotel, Sunny Beach, but after deducting bank charges.

3.3 In other cases, if the client meets the cancellation deadlines specified in the relevant offer under which the client made a reservation, the amounts paid will be refunded to the client in full by the Laguna Park & Aqua Club Hotel, Sunny Beach, after deducting bank charges, and this will be made through a transaction on the card with which the reservation payment was made, within 14 days of the date of cancellation of the reservation.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES:

4.1. The hotelier agrees to provide the standard for "four stars" travel services paid for by the User.

4.2. The hotelier reserves the right to refuse the accepted reservation without liability if the User fails to make full payment within the time limits specified.

4.3 The user agrees to:

4.3.1. Pay the value of the reservation within the time frame specified;

4.3.2 Obey the laws of the Republic of Bulgaria as well as the hotel's internal order regulations.

5. RESPONSIBILITIES OF THE PARTIES:

5.1. The hotelier takes no responsibility for the User in the event of force majeure, which may include: diseases, epidemics, natural disasters, strikes, hostilities both in the Republic of Bulgaria and abroad, threatening people's security or restricting their ability to move, government decisions, interruption of water, electricity, and other services from external suppliers over which the hotel has no control, as well as for any other unforeseen or insurmountable event of an extraordinary nature that occurred after the reservation, which can not be avoided by the Hotelier and his contractors in the fulfilment of their obligations.

5.2. The hotelier is only responsible for events that occur on the hotel and bears no responsibility to the User for food and beverages consumed outside of the hotel's designated areas or performing actions outside the hotel that are not common practice for the hotel.

5.3. The hotelier takes no responsibility for claims made by the User that are not reported by him/her during his/her stay in the hotel, are not confirmed by the medical team serving the hotel, or are not proven unequivocally and definitively that they arose as a direct result of culpable action or inaction on the part of Hotelier’s employees.

5.4. The hotelier may seek liability from the User in case of an event that may damage the personal dignity of the hotel staff, the hotel's reputation, or the hotel's property.

5.5. The hotelier is not responsible and owes no compensation or penalties if, as a result of the User's hooliganism or violation of the hotel's internal order rules, he/she was denied services or had to be ejected from the hotel. This is documented by a protocol signed by officials or other tourists present on site.

5.6. The hotelier is not responsible for services selected, self-organized and paid for by the User during his/her stay at the hotel.

5.7. The hotelier is not liable for any damages incurred by the User during his vacation as a result of criminal acts committed by third parties, including theft of the User's property or luggage. In such cases, the hotelier assists the User in completing the formalities for the registration of the criminal act so that other hotel guests' usual tourist vacation is not disrupted.

5.8. The hotelier is not liable and does not compensate the User if he/she refuses to use certain services or, for whatever reason, deviates, does not show up, or arrives late after the announced time and thus does not receive one or more services.

6. DISPUTES AND COMPLAINTS:

6.1. All disputes arising from the performance of the services under the reservation will be resolved by mutual agreement of the parties. If no agreement can be reached, they will be referred to the Bulgarian Court of Appeal. 6.2. If facts of non-fulfillment or incorrect execution of the provided standard services are established during the User's stay in the hotel, the User is required to immediately and in writing present his claim to the Hotelier and to request and receive a document certifying the claim for timely action. Complaints received outside of the hotel will not be accepted.

7. PERSONAL DATA

7.1.The Laguna Park & Aqua Club Hotel, Sunny Beach is owned by Nesebar In OOD, with UIC 812159044 and headquarters in Pomorie, 3 Odrin Street, which is a personal data administrator under the Personal Data Protection Act and is listed in the Commission for the Protection of Personal Data's register. When you provide your personal information, this happens in accordance with the requirements of the Tourism Act and related regulations. Your personal information will be used only for the purposes specified in these regulations. 7.2. Your personal information is processed and stored on both electronic and paper media. Your personal information is properly safeguarded by reliable methods and tools. Except as required by law, the Laguna Park & Aqua Club Hotel, Sunny Beach does not change or disclose personal data to its customers and does not provide personal data to third parties. Except with the subjects' explicit informed consent, the Laguna Park & Aqua Club Hotel, Sunny Beach does not process personal data for the purposes of direct marketing. The hotelier reserves the right to unilaterally change these General Terms, the structure and content of its website, as well as to terminate access to it at any time without being obliged to notify the User.
